Terms of Service

About this service

These terms govern Heretake at https://heretake.com. By creating an account or using the service, you agree to these terms and our Privacy Policy. Contact us at support@heretake.com for service, billing, privacy or safety matters.

Heretake creates AI images through curated portrait and artistic-avatar scenes and a free-form Studio. Scenes use reference photos and a chosen style. Studio accepts a text description and up to four optional reference photos, with a choice of image model. Generated images are delivered to your private account for download. Availability and processing time can depend on our generation services.

You must be at least 18. For single-person scenes, upload only yourself as an adult. Couple and wedding scenes support exactly two adults: you and another adult who has explicitly permitted you to upload their photo and generate these images. You must own or have the necessary rights to every photograph. Do not upload children, celebrities or anyone whose permission you do not have. Sign in with your own Google account or verified email and password, keep access secure and report suspected unauthorized use to support. You are responsible for activity you authorize through your account.

AI models used by the service

Heretake may use different image or video generation models for different features as the service develops. The models currently used by available features are listed below:

  • Scenes: ByteDance Seedream 5.0 Lite. Scene requests are processed through APIMart.

  • Studio: ByteDance Seedream 4.5 and Seedream 5.0 Lite, Google Nano Banana 2 (Gemini 3.1 Flash Image), and GPT Image 2. These models are accessed through APIMart. GPT Image 2 uses APIMart’s extended channel. Seedream 4.5 may fall back to the same model through OpenRouter (bytedance-seed/seedream-4.5). Studio does not automatically switch to a different model. Existing Nano Banana Pro jobs retain their original model and charge.

APIMart and OpenRouter provide access to models; they are not model names. Our current scene and artistic-style choices change the generation instructions, not the underlying model. Video generation is not currently offered.

The model lineup may change as features are added or improved. We will keep this list up to date when a model is added or replaced, and update our privacy disclosures when the services processing your uploads change. You do not need to select a model to use a scene.

Purchases and credits

Current packs and prices appear on Pricing. Each purchase is a separate payment: there is no subscription, recurring billing or automatic top-up. The amount, currency and any applicable tax are shown before you pay. Waffo Pancake handles hosted checkout as our payment and Merchant of Record provider. We do not receive your full card number or security code.

Credits become available after confirmed payment. Scene images currently cost one credit each and can be generated as a full set or as 1, 2 or 4 variations of one selected shot. Studio generates 1, 2 or 4 images; each output costs 1 credit with Seedream 4.5, Seedream 5.0 Lite or GPT Image 2, or 2 credits with Nano Banana 2. The image count and total credit cost appear before submission. Credits are deducted when we accept and create the generation task, before the images are finished. A new generation is a new charge, even if you use the same selfie. Downloading a completed image again does not consume credits.

Purchased credits have no scheduled expiry while your account remains open. Credits are for this service only, cannot be transferred or resold, and are not money or an investment. Future price changes apply to future purchases; they do not change the quantity in an already completed purchase. Free or promotional credits have no cash refund value. Sandbox checkout does not charge real money.

Failed images, refunds and billing problems

If an individual output fails technically and is marked failed, its credits are returned automatically. If part of a set succeeds, only failed outputs receive this automatic credit return. Returning credits is different from refunding a payment to your card.

You may request a full refund of a wholly unused credit pack within seven days of purchase. Contact support from your account email with the order reference and reason. Confirmed duplicate charges, incorrect charges and paid credits that cannot be delivered are eligible for correction or refund. Do not send card numbers or passwords.

Consumed credits are generally not refundable for a change of mind. AI results can vary in likeness, anatomy and style; if a result is unusable or does not resemble you, contact support with the generation reference for individual review. Aesthetic dissatisfaction does not trigger an automatic refund. This policy does not limit mandatory consumer remedies or withdrawal rights; using credits alone does not waive rights that require separate consent under applicable law.

We aim to acknowledge refund and billing requests within two business days and decide straightforward requests within ten business days. We will explain if an investigation needs longer. Approved payment refunds go through Waffo to the original payment method; the provider and bank determine when funds appear. Refunded credits are removed and cannot also be spent. You can contact Waffo using the details on your receipt as well.

Acceptable use and prohibited content

Do not upload, request, generate or distribute any of the following through Heretake:

  • Pornography, nudity, sexual acts, sexual exploitation or other sexually explicit / NSFW material.
  • Graphic violence, gore, torture, or content promoting violence or serious harm.
  • Hate speech, dehumanization, threats or abuse targeting protected groups or individuals.
  • Child sexual abuse material (CSAM), sexualized minors, grooming or any other child-unsafe or exploitative content. Images of minors are outside this service's scope entirely.
  • Deepfakes of other people, deceptive impersonation, non-consensual likeness use, fraud or misleading claims that generated scenes document real events.
  • Material that infringes copyright, trademarks, privacy, publicity or other third-party rights, including unauthorized protected images, logos or branding.

Do not bypass safeguards, use stolen payment methods, attack or scrape the service, access another account, or exploit technical failures to obtain credits. Do not use generated images for identity verification or as evidence of events that did not occur.

Moderation, reports and enforcement

Scenes combine curated prompts and styles with optional preferences. Studio accepts free-form descriptions and optional reference photos. Creation requires an adult confirmation and, when uploading people, confirmation that you have the necessary permission. Supported requests are validated on the server. Generation providers may apply their own automated safety filters. These controls are not a guarantee that every unsafe upload or output will be detected; Heretake does not claim that every image is manually reviewed before delivery.

Report suspected prohibited content or misuse to support@heretake.com. Include the relevant order or generation reference, the issue and enough information to locate it. Do not email illegal images, particularly suspected CSAM. We review reports and relevant account, transaction and content records where necessary, restrict access to that review, and request further information when needed. We prioritize reports concerning child safety or imminent harm. This inbox is not an emergency service.

Depending on severity, we may reject a request, restrict or remove content, temporarily suspend access, or terminate an account. We may preserve evidence and cooperate with lawful requests or make legally required reports. Where appropriate, we explain the action and allow an appeal by email; notice may be limited if it would compromise safety, a legal obligation or an investigation. Fraudulently obtained or abusive promotional credits may be revoked. Legitimately purchased unused credits are handled under our refund policy and applicable law, not automatically forfeited simply because an account is suspended.

Your images and intellectual property

You retain your rights in uploaded photographs. You allow us to process, temporarily store and transmit them to our service providers only as necessary to generate images, provide support and address security or legal issues described here and in our privacy policy. We do not publish your private creations as advertising without your permission.

You may download and use your outputs for lawful purposes subject to these terms and others' rights. AI outputs may not be unique or qualify for copyright protection everywhere; we do not promise exclusive rights or clearance of third-party rights. The Heretake brand, website design and software remain protected separately.

Availability and responsibility

Keep your own downloads of images you want to retain. We may maintain, change or discontinue features, and cannot promise uninterrupted service, a particular likeness, identical results or suitability for employment, identification or another specific purpose. Review images before sharing them and identify them as AI-generated where needed to avoid misleading others.

To the extent permitted by applicable law, the service is supplied as available without implied warranties of fitness, accuracy or uninterrupted operation. We are not responsible for indirect losses such as lost profits caused by use of the service. Our aggregate liability for claims relating to the service is limited to the payments you made to Heretake in the twelve months before the event giving rise to the claim. These limits do not exclude fraud, willful misconduct or any liability or consumer protection that cannot lawfully be limited.

Closing accounts and changes

You may stop using Heretake and request account closure at support@heretake.com. Download wanted images first; we will explain the treatment of unused credits and any records that must be retained before completing closure. If we permanently discontinue the service or terminate access for reasons unrelated to your breach, we will arrange a refund for remaining purchased credits attributable to unused service. Mandatory refund rights always remain available.

We may update these terms by publishing a dated version. Material changes will be brought to users' attention through the service or account email before they take effect where required. Changes do not retroactively remove accrued rights. If a clause is unenforceable, the remaining clauses continue to apply. Contact support first to seek a resolution to disputes; nothing here prevents you from using a competent court or exercising mandatory local consumer rights.
